Santa Rosa (CA) attorney: Can landlord evict for damage to door caused by paramedics?

Here's a Q&A from Avvo, in which I lay out the possible ways a landlord can evict in those circumstances. I think in this case the lease will not explicitly talk about repayment of damage from emergency personnel and she would have a good defense if the landlord tried to evict.

The damage was caused when paramedics had to break in to deal with a medical emer-gency I had more than a year ago. I've told the landlord I can't pay the amount in full at one time, but am willing to make payments of $20 per month. Alternatively, I've told the landlord he can deduct the full amount from my security deposit, and I will pay $20 per month to bring the deposit back to its original amount. I cannot afford any more per month at present due to unemployment. Can the landlord legally evict me under these circumstances?

Should we forgive all student loans?

So this page is going around Facebook: "A rising tide does, in fact, lift all boats - forgiving student loan debt, rather than tax cuts for corporations, millionaires and billionaires, has a MUCH greater chance of helping to rise that tide in a MUCH shorter time-frame. ..."

It goes on to state that there's a bill in Congress - H. Res 365, introduced by Rep. Hansen Clarke (D-MI), seeking student loan forgiveness as a means of economic stimulus.

In fact, this bill is something less than it appears.


It's a resolution "expressing the sense of the House of Representatives that Congress should cut the United States' true debt burden by reducing home mortgage balances, forgiving student loans, and bringing down overall personal debt."

No doubt, the existing student loan system is an abusive system, designed for the taxpayers to underwrite private schools' predatory practices, but signing a Facebook petition to support a resolution won't change a thing.

In Nashville - music and yoga

I'm in Nashville for the National Folk Festival, where we saw some great music including, Samba Mapangala & Orchestra Virgunga (East African rumba and soukous), Aubrey Gent (gospel with great steel guitar) and the Marshall Ford Swing Band (Bob Wills-inspired Texas swing).

After a blistering hot day Saturday, Sunday's rains provided welcome relief and we started off Sunday with a vigorous vinyasa (flow) yoga class at the lovely Sanctuary for Yoga.

Enjoying the lack of law in all this . . . but speaking of that, The Yoga Journal Conference in San Francisco features a 'business of yoga' track featuring attorney Andy Dudnick on legal issues affecting studios -- although it seems generalized to most small businesses.
